A trader filed a legal suit against JPJ as before he purchased his vehicle, he went to JPJ to conduct a search and a few months after his purchase, the vehicle was confiscated by JPJ as it was found to be a stolen vehicle. However, when the owner of the vehicle went to conduct the search, there were no discrepancy or inconsistency from the result of the search and hence his decision to purchase the vehicle.
He subsequently filed a legal suit against Registrar and Inspector of Motor Vehicle KL and Registrar and Inspector Motor Vehicles in Seremban and Malaysia Government for a negligence suit.

The Sesssions Court held the case in the owner's favour as it held that it was the negligcence of JPJ in not verifying the search properly and has a duty of care to the owner or anyone who filed and/or conduct search at JPJ to ensure that whatever stated on the document is prima facie a good document. So award was given in favour of the Owner of the Vehicle
